Exemption Application (1)
To Whom It May Concern
BoysTown is seeking a temporary exemption under the Sex Discrimination Act.
BoysTown is a not-for-profit organisation that helps marginalised children and young people aged to 25 years connect with the community. We provide help and reassurance to those experiencing life challenges that include: physical and emotional abuse, alcohol and drug abuse, homelessness, low literacy, long-term unemployment and mental illness.
BoysTown is seeking a temporary exemption for five years for employment in the position of Youth Construction Trainer. We believe it is essential that this position be filled by a man.
The Youth Construction Trainer is responsible for the delivery of quality training, mentoring and life skills development to the peoples of the Tjurabalan region of West Australia in order to effect long term sustainable change. The main responsibilities and duties of this position are listed below.
- To promote appropriate behaviour and be a positive role model to clients
- To deliver work based program activities that assist clients to achieve sustainable change
- To achieve work project contractual obligations and production targets
- Ensure quality delivery of services which include, construction and refurbishment of new and existing buildings
- Maintain accurate records as required and provide accurate and timely reporting for internal and external consumption
- Delivery of quality training programs
- In conjunction with BoysTown’s Accredited Training team and processes, undertake assessment of the training competencies and contribute to the development of training content as required
- Foster a sense of independence and well-being in clients
Identify client’s needs and liaise with BoysTown support workers to ensure the personal needs and issues of each individual client are being addressed - Promote a positive Workplace Health and Safety culture and ensure active compliance to standards and regulations
- Maintain tools and equipment to ensure safety, effectiveness and reliability
- Oversee the day to day security of all materials, supplies, tools, vehicles and equipment
- Perform other duties as may be required in order to achieve the objectives of the service.
This exemption is necessary as BoysTown's operations in the Tjurabalan region respects the traditions and "Lores" of the Aboriginal Peoples. Cultural protocol and practices relative to the initiation process and skin groupings dictate that young men are taught by older males and male "Lore" Givers.
In terms of young women, the same situation applies. The women of the Tjurabalan are also governed by "Lore" and aligned responsibilities and protocols. Similarly they are taught by older women and female "Lore" Givers.
Two groups of people will be affected by this application: applicants for the position, and the clients who use BoysTown’s services. The latter will be affected in that they will come into contact with the successful applicant.
This application is in line with the exemptions allowed for by the Sex Discrimination Act. The SDA states that it is not unlawful for a person to discriminate against another person, on the ground of the other person’s sex, in connection with a position as an employee, when that position requires a genuine occupational qualification to be a person of the opposite sex to the sex of the other person.
This application is urgent as the recruitment process for this position needs to commence as soon as possible.
Please contact me if you have any questions regarding this application.
