President speech: Human rights, the Constitution and a Human Rights Act

I’d like to begin by acknowledging the Gadigal people of the Eora Nation on whose land we are today and pay my respects to their elders. I’d like to thank the organisers for inviting me to speak, and I would like to acknowledge you, the Aboriginal field staff. You have an important role and I pay tribute to you and your work.
In the United States, 54 years ago today, Rosa Parks was arrested. Rosa Parks was a black woman, arrested for refusing to sit at the back of a bus. It's appalling to think this occurred. It's even more appalling that 54 years later in Australia, many people with disability can't even get on the bus.
In the contemporary world, and particularly amongst developed economies, many of us believed that the culture of civil liberties, freedoms and non-discrimination are reasonably well established and these precepts have clear links to innovation, creativity and the broader concepts of economic productivity and a well functioning civil society. Indeed, I believe that many of us had come to accept and expect this to be the situation, and that conferences like the one we attend here today could be built on this very premise.
I would like to acknowledge the Gadigal people of the Eora people, the traditional owners of the land on which we meet today, and pay my respects to their elders.
We are on Aboriginal land – and as a mark of respect to the traditional owners of this country – I want to recognise their culture and their law because they are integral to what we now call Coogee.
Thank you for the opportunity to be here today. Can I begin by apologising for the Acting Disability Discrimination Commissioner Dr Sev Ozdowski. Sev has been following this inquiry very closely but had arranged to be away this week before the schedule for these hearings was settled.
I would like to begin by acknowledging the Traditional Owners of this land, the Pambalong clan of the Awabakal people, and pay my respect to their elders, past and present. Today I would like to explore the question: ‘What does it mean to believe in human rights in Australia today?’ This is an ambitious project, and I am aware that the question does not have a short and simple answer.
Good evening distinguished guests, my Indigenous brothers and sisters and non Indigenous friends. May I begin by acknowledging the Wurrundjeri People of the Kulin Nation on whose land we are meeting on tonight, and thank the dancers for cultural expression and your welcome to country. Thank you also to the Vice Chancellor, Professor Paul Johnson for your introduction, and to La Trobe University for inviting me to present this year’s Hyllus Maris Memorial Lecture. May I also acknowledge Ms Lois Peeler and the other family members of Hyllus Maris who are with us tonight.
Over the last four years the Human Rights and Equal Opportunity Commission (the Commission) has played a key role in raising community awareness about the human rights Australians with a mental illness. The Commission, through its public inquiry process, brought into national focus how, amongst other things, people affected by mental illness frequently faced discrimination and stigmatisation based on ignorance, fear and inaccurate stereotypes.

Thank you for inviting me here today, to speak about a topic which in my view receives too little attention yet is one of critical importance not only to the way we live but to the kind of society we live in – the topic of human rights education.
