Summary

The Australian Human Rights Commission makes this submission to the Senate Legal and Constitutional Affairs Legislation Committee in relation to its review of the operation of the National Emergency Declaration Act 2020 (Cth).

The Act aims to clarify and consolidate the Commonwealth’s various emergency powers and functions and establish a framework by which the Governor-General, on the advice of the Prime Minister, may declare a national emergency, triggering the Commonwealth’s ability to exercise its emergency powers and perform its emergency functions.
