The Social Justice Report 2005 covers the period from 1 July 2004 to 30 June 2005. The Report considers progress in achieving improvements in the health status of Aboriginal and Torres Strait Islander peoples and sets out a human rights framework for achieving health equality within a generation.

In those States in which ethnic, religious or linguistic minorities … exist, a child belonging to such a minority … shall not be denied the right, in community with other members of his or her group, to enjoy his or her own culture, to profess and practise his or her own religion, or to use his or her own language.

The current mandatory detention policy of the Commonwealth of Australia breaches the fundamental principle of the rights of the child which is that children should be able to develop to their full potential. The policy breaches every article of the Convention on the Rights of the Child. The policy violates the right to health as established by international law.

States Parties recognize the right of the child to education and with a view to achieving this right progressively and on the basis of equal opportunity, they shall, in particular:

I am primarily a paediatric doctor. I saw many of the children in [Woomera] … and really so many of their problems relate directly to the prolonged and indeterminate nature of their detention, which is a combination of the very harsh and isolated physical environment, the poor accommodation facilities and the lack of resources for their mental health and their leisure activities.
