Summary

Explore 4 highlights of the Commission's work over the last 40 years in relation to promoting and protecting the rights of LGBTIQA+ people.  

The Commission began advocating for the rights of LGBTIAQ+ people from the early 1990s. However, formal and sustained advocacy for the broader LGBTIAQ+ community began in the mid-2000s.

A key moment in terms of our work in relation to the LGBTIQA+ community came in 2013 when the Sex Discrimination Act 1984 was amended to include sexual orientation, gender identity and intersex status as protected attributes. As administrator of the Act, our capacity to respond to issues and complaints related to LGBTIAQ+ discrimination was significantly expanded.

The Commission is proud to have been involved in helping deliver many legal and policy reforms over many decades which have benefitted the LGBTIQA+ community, and we acknowledge, honour and celebrate the vital work of many LGBTIQA+ advocates over this time.

Here are 4 key ways the Commission has helped improve the lives of LGBTIQA+ people in Australia:

Ending discrimination in federal law against people in same-sex relationships

Through a landmark 2006/2007 inquiry and report, the Commission initiated the process for eliminating almost all forms of discrimination in federal legislation against same sex couples.

The video features our Human Rights Commissioner from 2007 Graeme Innes and LGBTIQA+ activists from the time as they reflect on the impact of the Same Sex: Same Entitlements inquiry and report and how they paved the way for other key reforms such as marriage equality.

Embedding national protections for same-sex sexual conduct in federal law

In 1994, the Commission helped deliver the federal Human Rights (Sexual Conduct) Act, using international human rights law to overcome the stubbornness of the then Tasmanian government in relation to decriminalising homosexuality. Read the story (see below).

Advancing the rights of transgender people

In 2019, the Commission helped author a breakthrough report which continues to provide guidance to sporting organisations for the inclusion of trans and gender diverse people in sport.  Read the story (see below).

Advancing the rights of intersex people

A groundbreaking 2021 report from the Commission paved the way for protecting the rights of young people with variations in sex characteristics.  Read the story (see below).
