About the complaint

The complainant was 41 years of age and applied for a job at the respondent retailer, stating he was willing to learn new skills. He alleged that the retailer refused to consider his resume and told him “Learning is for 15 years olds who are working for $14 an hour, not $32 an hour”.

The retailer denied the alleged comments and agreed to participate in conciliation to try to resolve the complaint.

The complaint was resolved with an agreement that the retailer would write to the complainant apologising for the events giving rise to the complaint and roll out an online discrimination training module to all staff.
