About the complaint
The complainant has epilepsy and applied for a role as an industrial painter and blaster with the respondent mining company. The complainant said he provided information from his treating doctor to the company declaring him fit to perform the role, but claimed the company sought additional information, including from a neurologist. He alleged the company delayed the recruitment process and did not respond to his enquiries.
The company said the complainant’s neurologist did not declare him fit to perform the role safely and the company has an obligation to ensure the health and safety of its employees.
The complaint was resolved with an agreement that the company pay the complainant $2,000.
