About the complaint
The complainant alleged the respondent company withdrew its offer of employment one business day before their commencement date because of their criminal record. The complainant was convicted of a drug-related offence and served a short custodial sentence.
The company said that the offer of employment was conditional on the completion of satisfactory background checks and given the nature of the role the complainant’s record was deemed to be unsatisfactory, therefore the company withdrew the conditional offer of employment.
The complaint was resolved with an agreement that the company pay the complainant $1,350.
