The complainant is Indian and was employed as a care worker with the respondent aged care provider. She alleged a trainee nurse accused her of being aggressive and yelling at clients. The complainant believed this perception arose due to her accent. She alleged that during a meeting about the incident, the organisation dismissed her version of events and terminated her employment.
The aged care provider said the complainant’s race was not a factor in the decision to terminate her employment and claimed the complainant’s employment was terminated due to misconduct.
The complaint was resolved by conciliation with an agreement that the aged care provider pay the complainant $5,000.
