The Australian Human Rights Commission (the Commission) made a submission to the Senate Standing Community Affairs Legislation Committee as part of its inquiry into the NDIS Amendment (Securing the NDIS for Future Generations) Bill 2026 (the Bill).
The submission raises concerns about the Bill’s potential human rights impacts, including changes that may reduce access to supports, limit individualised decision-making, and weaken safeguards for participants. It also highlights limited consultation with people with disability and the absence of a clear framework to measure how the reforms will affect people’s rights in practice.
The submission calls for the Bill to not be passed before:
- the Parliamentary Joint Committee on Human Rights (PJCHR) has assessed the Bill and reviewed the Statement of Compatibility with Human Rights;
- a comprehensive gender impact analysis is completed; and
- there has been closer consultation with the disability community and they are actively involved in the reform.
