About the complaint
The complainant has arthritis and performed console based duties on a casual basis for the respondent carwash. He said that from time to time, he required the use of a chair to accommodate his disability. He alleged that his chair was removed and he was not offered work for a time to undergo unnecessary medical assessments before being allowed to return to work.
On being advised of the complaint, the business indicated a willingness to participate in conciliation to try to resolve the complaint.
The complaint was resolved with an agreement that the business pay the complainant $9,000, make a contribution to his superannuation and provide him with a statement of service. The parties agreed to end the employment relationship.
