HREOC is a statutory body independent of government. While our main function is to promote an understanding and acceptance of human rights in Australia, we are also charged with the responsibilities of investigating, and attempting to conciliate complaints of unlawful discrimination under the federal Racial Discrimination Act 1975, the Sex Discrimination Act 1984, the Disability Discrimination Act 1992 and the Age Discrimination Act 2004.1 HREOC also has specific responsibilities to report annually to Parliament on the enjoyment of human rights of Indigenous Australians.

In some ways I think I have been asked to teach my grandmother to suck eggs (though I am sure my own venerable forebear did no such thing!). I would say that there is no industry more skilled in the art of disability discrimination than the insurance and superannuation industry. Before you decide I am irretrievably biased against your work let me explain that, of course, I understand such discrimination is the basis of your enterprise.

As you know, the Commonwealth Disability Discrimination Act, and equivalent laws in all States, make it unlawful to discriminate on the ground of a person's disability. One of the areas covered by the Act is access to premises. The only exception to this is where a building is already constructed not providing access, and alteration to provide access would cause unjustifiable hardship.

While there is no section in the Disability Discrimination Act titled "Tourism" every aspect of the development, management and delivery of tourist services are covered by one or more provision within the DDA.

Thanks for the chance to speak with you today. As you might guess, in my role as Disability Discrimination Commissioner, I receive many invitations to speak at functions on the international day. One of the reasons I chose this invitation is because of the really important role that Local Government plays in the lives of all Australians. It deals with the issues that are in your face- and I know, because until two years ago I was a Councillor on Ku-Ring-Gai Council.
