I would like to begin by acknowledging the traditional owners of the land on which we meet - the Waradjuri nation and the elders present. I also acknowledge our hosts - the Dijrruwang Program at Charles Sturt University , and thank you for inviting me here to address this Gathering.

This morning about 20,000 Australians woke up in a prison cell. What will their day bring? Most of you know far more about that than I do and that is precisely why we have called upon your expertise for today's workshop.

Amongst all this expertise, it is fair to ask why is the President of the national human rights commission – and particularly a President who has only fairly recently commenced in this role - here presenting the keynote speech to such a conference?

I am not here to present South Australia's government as having achieved the last word in access and inclusion for people with disabilities, any more than this report itself seeks to claim that the task is finished.

Since the terrorist attacks on September 11 2001, Governments around the world have created a raft of new counter-terrorism laws. In Australia alone, over 40 new laws have created new criminal offences, new detention and questioning powers for police and security apparatus, new powers for the Attorney-General to proscribe terrorist organisations, new ways to control people’s movement and activities without criminal convictions, and new investigative powers for police and security agencies.

Thank you to the Public Health Association for inviting me to deliver the Sax Oration this year. I am honoured to follow so many distinguished speakers who have delivered the oration over the years. I am honoured too to be able to commemorate the work of Sidney Sax, one of the most significant people shaping health care policy and practice in Australia.

This paper advocates that National Human Rights Institutions (NHRIs) have a very valuable role to play in the Pacific, and that the promotion and protection of human rights in the Pacific would benefit immensely by Pacific nations each establishing a NHRI.

Conspicuously active in retirement! Perhaps most notably his Grotius Lecture in London last month in which he raised serious doubts as to the legality under international law of Britain’s invasion of Iraq. This is hardly the path of a man seeking a quiet retirement.
