The aim of this paper is to examine the use of Alternative Dispute Resolution [3] (ADR) in the context of the administration of complaints under anti-discrimination and human rights law.

The Racial Hatred Act, introduced in October 1995, extends the coverage of the RDA so that people can complain to the Australian Human Rights Commission about racially offensive or abusive behaviour. It aims to strike a balance between two valued rights: the right to communicate freely and the right to live free from vilification.

Under the Native Title Act 1993, the Social Justice Commissioner is required to prepare a Native Title Report each year for federal Parliament. Through these reports the Commissioner gives a human rights perspective on native title issues and advocates for practical co-existence between Indigenous and non-Indigenous groups in using land.
