The disappearance of so many is a solemn reminder of the injustice done to the first peoples of this land. Their violent absence is a presence that calls for us to reflect on injustices, suffering and reconciliation in the broadest sense. To them I pay my respects. -

This, my first report under s209 of the Native Title Act 1993 (Cth) (NTA), is part of a larger project that commenced prior to my appointment as Aboriginal and Torres Strait Islander Social Justice Commissioner in July 2004. The deceased had been arrested for driving under the influence of alcohol and for driving while disqualified. He was placed in what the Coroner described as an enclosed cell, in which occupant vision is impossible, at around 3.00am and told he would remain there for a period of four hours.
