The United Nations Youth Association of Australia welcomes the opportunity to contribute to the Human Rights and Equal Opportunity Commission Inquiry into Children in Immigration Detention. The issue of immigration detention for children has been coming under increased scrutiny in the past eight months. As far as it affects our international standing, the standards by which we treat children and our policies regarding refugees, it is a matter of great importance, which must be rigorously discussed in the public arena.

Pursuant to section 11(1)(f)(ii) of the Human Rights and Equal Opportunity Commission Act 1986 (Cth), I attach a report of my inquiry into complaints made by Ms Susan Campbell that the human rights of her daughter were breached by the Commonwealth of Australia. I have found that acts or practices of the Commonwealth were inconsistent with or contrary to the human rights of Ms Campbell’s daughter as provided for in Article 3(1) and 19 of the Convention on the Rights of the Child.

Under the AHRC Act, an employer can make a distinction against someone with a criminal record if the person’s particular criminal record means that they are unable to fulfil the inherent requirements of the job. Another way of putting this is that an employer can make a distinction against someone if the criminal record is relevant to the job. neglected child - a child found begging, wandering about or frequenting any thoroughfare or tavern, sleeping in the open air and who has no settled place of abode or means of subsistence; residing in any brothel or associating or dwelling with any person, known or reputed to be a thief, prostitute or drunkard or a person convicted of vagrancy; a child having committed an offence and who, in the opinion of the Justices, ought to be sent to an industrial school; an inmate of an immigrants' home or a child whose parent cannot control him/her and want him/her to be placed in an industrial school.

There are not enough services available to students with disability to match the requirements. In early education, a mix of services is often required. In schools, physical access limits choice, as does provision of support services and a selection of schools prepared to provide full access to the curriculum. Rural, regional and isolated areas provide minimal option (see also transitional services and post-school options).
