States Parties recognise that a mentally or physically disabled child should enjoy a full and decent life, in conditions which ensure dignity, promote self-reliance and facilitate the child's active participation in the community.

In the Social Justice Report 1999, my first report as Social Justice Commissioner, I identified four key themes and challenges that existed in the approach of the federal government to Indigenous policy making at the time. These were moving beyond welfare dependency, accountability, participation and reconciliation.[1] Since the release of that report approximately four years ago, the key themes and challenges facing the government have remained relatively constant.

We have developed Key Performance Indicators (KPIs) and standards that form the basis for ongoing assessment of the complaint service. These indicators, and our performance in 2011-12 in relation to these indicators, are summarised below. This will be how we assess the success or otherwise of the reconciliation process in years to come. The reconciliation process has the potential to be as significant, and difficult, as the process that led to the joining together of the states into one indissoluble federation in 1901. It challenges us to adapt the structures of society in ways that ensure that first nation peoples can participate fully, be welcomed and have our cultures respected. Integral to this process is an acknowledgement of the wrongs of the past and an acceptance of the need for a restructured relationship.

My family went to Cherbourg. They volunteered to go there during the Depression. So I would have been about 6 months old when grandfather, who was, I mean, he was independent. He had eight kids all birthed out in the trees you know, under the stars. My mother spoke her own language. She had me with the promise to marry my father. And then when the Depression came they talked to the policeman. He said go to Buramba. When things get better come back out again. He was the Protector so he sent them there. The thing is though, when we got there you got caught up in the system.

Family violence and abuse occurs at unacceptable rates in Aboriginal and Torres Strait Islander (Indigenous) communities. We have heard many tragic stories of women, children and young people who have experienced devastating sexual abuse and family violence. It is a scourge that is causing damage and trauma among Indigenous communities, to our women and children, and to the fabric of Indigenous cultures.
