This submission is made by the Aboriginal and Torres Strait Islander Social Justice Commissioner on behalf of the Human Rights and Equal Opportunity Commission (HREOC) of Australia. In recent years the Commissioner has undertaken many activities relating to the rights of Indigenous children. This submission provides an overview of the inequality and discrimination faced by Aboriginal and Torres Strait Islander children in Australia, and key concerns in relation to the Convention on the Rights of the Child in addressing this. -

Same-Sex: Same Entitlements: Chapter 3
This chapter explains how the provisions of international human rights treaties protect same-sex couples and their children, in the context of accessing financial and work-related entitlements. In particular, this chapter focuses on the right to non-discrimination on the grounds of sexual orientation. It also describes how the breach of that right can interfere with a range of other basic human rights, for example, the right to social security. The chapter also explains how discrimination against parents on the grounds of sexual orientation can impact on the rights of their children. -

Commission Determinations, DDA decisions
Prior to changes made by the Human Rights Legislation Amendment Act 1999 which took effect in April 2000, the Australian Human Rights Commission conducted hearings and made determinations on Disability Discrimination Act complaints referred to it by the Disability Discrimination Commissioner or delegate. Complaints were referred to the Commission because the complaint could not be settled by conciliation or because the nature of the matter was such that it should be determined by the Commission.
