National Inquiry into Children in Immigration Detention
CARAD is a group of volunteers, supporters and donors formed from January 2000, in an attempt to meet some of the range of essential and urgent needs of refugees who reach Perth, following assessment of their claim while in a detention centre. We have now met in excess of 2,000 refugees, not all of whom remain in WA, and have provided them with compassionate, practical assistance. We estimate that there are about 1000 individual volunteers, supporters and donors affiliated with CARAD. -

The Commission's jurisdiction to hear and determine complaints of unlawful discrimination ceased on 13 April 2000 with the commencement of the Human Rights Legislation Amendment Act (No.1) 1999 (Cth) and was transferred to the Federal Court and Federal Magistrates Service. The Commission retained the jurisdiction to complete those public inquiries that had commenced prior to 13 April 2000. -

Australia currently holds about 800 children in mandatory closed immigration detention for indefinite periods, with no pathway to protection or settlement. This includes 186 children detained on Nauru. Children and their families have been held on the mainland and on Christmas Island for, on average, one year and two months. Over 167 babies have been born in detention within the last 24 months. This Report gives a voice to these children. -

Australia's Immigration Detention Centres are contradictory to the human rights of the child. The Immigration Detention experience is extremely harmful to children and has effects of traumatisation and re-traumatisation during the Detention experience and continuing after release. Concerning alternatives to Detention, the present options are also not geared towards the best interest of the child. -

This submission addresses some of the issues and questions raised in the background papers prepared by the Human Rights and Equal Opportunity Commission (HREOC) and in relation to the United Nations Convention on the Rights of the Child (1989) and the Convention Relating to the Status of Refugees (1951) and its 1967 Protocol (the Refugee Convention). The conclusions drawn in this submission arise out of the experiences of staff and members of the Uniting Church in Australia. We do acknowledge that the evidence presented here is therefore anecdotal. -

It must also be recognised that many children in detention centres have been deeply damaged - further trauma could be avoided, in part, by prudent selection and training of staff and guards. It needs to be assured that only staff who have learned to respect relevant cultures, religious traditions and are knowledgeable of the human rights of asylum seekers and the often traumatic conditions of countries from which the people have fled and been exposed to, will be selected for employment. -

My name is Keysar Trad. I am the Vice President of the Lebanese Muslims Association in Sydney. The Lebanese Muslims Association was established in 1961 by a group of Lebanese Muslim citizens to advocate on behalf of Lebanese and other Muslims in the Australian community. We have over 1100 financial members and over tens of thousands who use our facilities on festive occasions, many or our members (financial and non financial) meet at our mosques five times a day to offer worship and over 5000 members meet every Friday at midday for worship services. -

Submission: MIGRATION AMENDMENT (DESIGNATED UNAUTHORISED ARRIVALS) BILL 2006
This Bill represents a backward step in Australia's treatment of asylum seekers. The Commission acknowledges that important improvements have been made in relation to Australia's treatment of asylum seekers. We have witnessed the removal of children from detention centres, the implementation of time limits on processing protection claims, the introduction of independent review of long-term detention and, in October last year, the removal of almost all of the remaining asylum seekers detained on Nauru, after concerns about their deteriorating mental health.
