Those who've come across the seas: Detention of unauthorised arrivals (1998)
HREOC’s report, tabled in federal Parliament on 12 May 1998, deals with the policy of mandatory detention of most unauthorised arrivals and the conditions of detention for those detained. The report had its origins in the many complaints received by HREOC from, or on behalf of, people in immigration detention centres. -

As a counsellor of children and families at risk of child abuse and neglect, I have a number of concerns about the children being held in immigration detention in Australia and in our region on the request of Australian authorities. In my professional capacity I see children who have been abused by their Australian families. I find it appalling that Australia as a nation is now systematically abusing children whose parents have sought asylum here. In the following submission I offer suggestions under a number of headings: -

Where a complaint is made under the Human Rights and Equal Opportunity Commission Act 1986 (Cth) alleging breaches of human rights and discrimination in employment, the President or his delegate may report to the Attorney-General where conciliation cannot resolve the matter and an inquiry has satisfied the President there has been a breach of human rights or discrimination in employment. The Legal Section assists the President or his delegate to inquire into the complaints and prepare reports to the Attorney-General. -

The visit was conducted by Commission President and Human Rights Commissioner, Catherine Branson QC, as well as Commission staff and consultants including a consultant psychiatrist. -

The Tasmanian Government recognises the Federal Government's responsibilities for the management of immigration to Australia. During the last decade a policy of mandatory detention has been established for those who enter Australia without proper authority (an appropriate visa). A period of detention allows the Commonwealth Government to ensure that those unauthorised arrivals do not have a health status, character or criminal record of concern to the Government. -

The detention of children and young people is poses significant risks to normal development. The exposure of infants and young children to stress either directly or mediated through the experiences of their parents reduces the likelihood of normal brain development. -

The Australian Psychological Society categorically condemns the practice of detaining child asylum seekers and their families, on the grounds that it is not commensurate with psychological best practice concerning children’s development and mental health and wellbeing. Detention of children in this fashion is also arguably a violation of the UN Convention on the Rights of the Child. -

Refugees are a group at high nutrition risk. There is a strong duty of adequate nutritional care for institutionalised persons. The Dietitians Association of Australia (DAA) is the largest member organisation for nutrition professionals in Australia. It is notable that DAA has been unable to identify significant input by nutrition professionals into the planning or provision of care for asylum seekers in Australia. -

States Parties shall take appropriate measures to ensure that a child who is seeking refugee status or who is considered a refugee in accordance with applicable international or domestic law and procedures shall, whether unaccompanied or accompanied by his or her parents or by any other person, receive appropriate protection and humanitarian assistance in the enjoyment of applicable rights set forth in the present Convention and in other international human rights or humanitarian instruments to which the said States are Parties. -
