I attach a report of my inquiry into complaints by Mr Huong Hai Nguyen and Mr Austin Okoye against the Commonwealth of Australia and GSL (Australia) Pty Ltd, pursuant to section 11(1)(f)(ii) of the Human Rights and Equal Opportunity Commission Act 1986 (Cth).

Australian law requires the detention of all non-citizens who are in Australia without a valid visa (unlawful non-citizens). This means that immigration officials have no choice but to detain persons who arrive without a visa (unauthorised arrivals), or persons who arrive with a visa and subsequently become unlawful because their visa has expired or been cancelled (authorised arrivals). Australian law makes no distinction between the detention of adults and children.

The project was officially supported by the Federation of Ethnic Communities’ Council of Australia, the Equal Opportunity Commission Victoria, the Ethnic Communities’ Council of Victoria, the Islamic Council of Victoria, the Islamic Girls’ and Women's Group, the Centre for Multicultural Youth Issues, the Victorian Immigrant and Refugee Women’s Coalition and Goulburn Ovens Institute of TAFE. The support of all of these organisations was vital to the overall success of the forum.

During these ten years, thousands of individuals and organisations have used the DDA to create change, either by making complaints of discrimination, using the law as a basis for negotiating broad social change or educating organisations on their responsibilities.

The 2000 Social Justice Report is the second by Dr Jonas. It tabled in both houses of the federal Parliament on 28 March 2001. The theme of the report is reconciliation and human rights.

In recent years there have been significant developments at the international level that impact upon the recognition and protection of the human rights of indigenous peoples. In 1863 the area now known as the Northern Territory came under the control of South Australia. By 1903 the whole area was leased to non-Indigenous people. As there were few non-Indigenous women, relationships between the Indigenous women and non-Indigenous men were relatively common. The consequence was a growing population of children of mixed descent who were usually cared for by their mothers within the Aboriginal community.

Protecting the best interests of a child is one of the most important principles of international law and the Convention on the Rights of the Child (CRC) in particular. This chapter focuses on whether federal law currently protects the best interests of a child being raised by lesbian or gay parents.

It was a landmark for Australia - the first federal law to say that all people have the right to be treated fairly, regardless of their background, culture or colour.
