In 2011–12 the Commission received 17 047 enquiries and 2 610 complaints. This is the highest number of complaints received over the past 10 years and 21% higher than the number of complaints received in the previous reporting year.

We have developed Key Performance Indicators (KPIs) and standards that form the basis for ongoing assessment of the complaint service. These indicators, and our performance in 2011-12 in relation to these indicators, are summarised below. In comparison with the last reporting year, the Service has seen a level of improvement across all KPIs.

These Principles were developed by a forum of Indigenous people from Australia's major mineral resource regions, held in Alice Springs in May 2002. Participants had a depth of experience and expertise in areas across the country, but the process did not make any claim to represent a national Indigenous view. In June 2011, the Commission welcomed action taken by the Australian Government to move a significant number of families and unaccompanied children from immigration detention facilities to community-based detention.

The ACTU believes that an inquiry, as a vehicle for public education, would assist to promote employment opportunities for people with disability. Additionally the inquiry would provide the opportunity to consider ways to facilitate employment participation and could therefore provide a means to report and make recommendations to Government.

The Commission assesses compliance with human rights principles by examining and reporting on issues of race, age, sex and disability discrimination and human rights. In doing so, we play a significant role in the monitoring of legislation and policy in Australia.

The 'right to negotiate' is a fundamental right assured by the Commonwealth Native Title Act (the 'NTA') and reflected in international human rights standards. Yet in practice the capacity of native title parties to exercise their 'right to negotiate' is determined by factors other than the mere existence of the right. Given the primary role of state and territory governments in land administration, their policies regarding the administration of the right to negotiate have a significant impact on native title parties' capacity to exercise their 'right to negotiate'.
