One of the underlying goals of international and Australian laws relating to children with disabilities is to provide the highest possible level of support and assistance in the least restrictive way. Laws, policies and programs should be designed to ensure that children with disabilities have the opportunity to participate, to the maximum extent possible, in all aspects of the general community.

We must face up to our humanitarian responsibilities to accept refugee children and their families. We must take them out of the immigration detention centres and welcome them into the community where they can play, learn and grow. At least then when our children look back on this time and ask us what we did to stand up for refugee kids, we can say we gave them their childhood." (Calvert, 2001).

The United Nations Youth Association of Australia welcomes the opportunity to contribute to the Human Rights and Equal Opportunity Commission Inquiry into Children in Immigration Detention. The issue of immigration detention for children has been coming under increased scrutiny in the past eight months. As far as it affects our international standing, the standards by which we treat children and our policies regarding refugees, it is a matter of great importance, which must be rigorously discussed in the public arena.

The Commission would like to thank the children and young people who participated in the project and demonstrated great courage in allowing us to hear and tell their often painful and traumatic stories, in a hope that things would change for the better.

This report to the Attorney-General concerns inquiries made by the Human Rights and Equal Opportunity Commission ('the Commission') into complaints by Quan Ri Qing and Su Yu Fei against the Commonwealth of Australia, Department of Immigration and Multicultural Affairs ('the Department') concerning violations of human rights under the Human Rights and Equal Opportunity Commission Act 1986 (Cth) ('the HREOC Act') which allegedly occurred during the detention of the complainants as unauthorised arrivals at the Port Hedland Detention Centre in 1996.

(a) whether the finding of the Committee on the Elimination of Racial Discrimination (CERD Committee) that the Native Title Amendment Act 1998 is inconsistent with Australia's international legal obligations, in particular the Convention on the Elimination of all Forms of Racial Discrimination, is sustainable on the weight of informed opinion;

In my previous two Native Title Reports, I have strongly argued the need to reform the native title system. Stakeholders from all sectors engaged in the native title system have also stressed the need for the Government to take significant steps to ensure that the system meets the original objectives set out in the preamble to the Native Title Act 1993 (Cth) (Native Title Act).

As part of the Ismaع project, the Human Rights and Equal Opportunity Commission (the Commission) investigated existing initiatives that address anti-Arab or anti-Muslim prejudice at a local, state and federal level across Australia. We conducted research and requested information about current initiatives from seven federal government agencies, 37 state and territory government agencies (including education and police authorities), 83 local governments (mostly in areas with substantial Arab or Muslim populations) and 14 non-government and community organisations.

The Complaint Handling Section (CHS) is responsible for investigating and conciliating complaints lodged under federal anti-discrimination and human rights law. Accordingly, the CHS plays a key role in fulfilling the Commission’s objective of delivering an Australian society in which human rights are protected.

The recognition of native title by the High Court in 1992 was a significant development in the legal apparatus for protecting Indigenous culture. Under the concept of native title it is possible that sacred and significant sites and objects might be protected, not within the historical category of Aboriginal heritage, but as matters valued in contemporary Indigenous culture with current significance to a people whose culture is ongoing. In addition, under native title such protection could be provided, not as an act of beneficence by government, but as a matter of legal right.
