The Right to a Discrimination-Free Workplace
The prohibition on discrimination in employment is a relatively recent, but now well-established, feature of the Australian legal environment. Laws prohibiting discrimination in the workplace in Australia date back to 1966 when South Australia introduced the Prohibition of Discrimination Act 1966 (SA), to prohibit discrimination on the grounds of race in aspects of employment and in the provision of goods and services.[1] -

Human rights for people with intellectual disabilities in Australia: where to from here?
I will not speak in detail about human rights conventions and disability because this topic is addressed by my co-speaker in this session, Karl Lachwitz. I will say though that international human rights law and human rights debate has not yet acknowledged adequately or sufficiently clearly that people with a disability are part of what the "human" in human rights means. Equally, there has not always been enough attention to human rights dimensions in disability discourse. -

Allow me to commence by acknowledging the traditional owners of the land on which we stand. This acknowledgment reminds us of cultural traditions stretching back to time immemorial, as well as aspirations in our own time for a fair and inclusive society. I am delighted to be here today to help: -

Chapter 2: Constitutional reform: Creating a nation for all of us - Social Justice Report 2010
A century ago, the Australian people engaged in a debate about creating a nation. They held meetings...They wrote articles and letters in newspapers. Many views were canvassed and voices were heard. The separate colonies, having divided up the land between them, discussed ways of sharing powers in order to achieve a vision of a united Australia. The result was the Australian Constitution, establishing the Commonwealth of Australia in 1901. -

Chapter 1: A cause for cautious optimism: The year in review - Social Justice Report 2011
As I reflect on the events that have taken place during the reporting period from 1 July 2010 to 30 June 2011, I see cause for optimism whilst also acknowledging there are still some areas that remain a concern. Over the last year we have reached some major milestones. For instance, we have seen the election of the two co-chairs and a board to the National Congress of Australia’s First Peoples (National Congress), and we are also now engaged in a conversation with the Australian people about how we go about recognising Aboriginal and Torres Strait Islander peoples in our Constitution. -

Appendix 5 The use of statistical evidence
This short paper is concerned, first, to examine the significance in a particular case of statistical evidence; secondly, to examine what it means to prove a fact on ‘the balance of probabilities’; and finally to examine the significance of relying on statistical evidence to establish an accused person’s age in the context of s 236B of the Migration Act 1958 (Cth). -

Bill of rights is essential to best serve human rights (2008)
Five years ago I began my term as the President of the Australian Human Rights Commission, confident in the ability of the common law and a robust democracy to protect human rights. I leave convinced we need a major legal and cultural overhaul in order to deal with the human rights challenges of the 21st century. -

Community arrangements for asylum seekers, refugees and stateless persons - Some barriers to use of community arrangements
Despite the significant positive developments of the past two years, the Commission remains seriously concerned about some aspects of Australian law and policy on asylum seekers, refugees and immigration detention. The Commission is primarily concerned about the prolonged or indefinite detention and lack of durable solutions or substantive visa pathways for certain groups of people in immigration detention. These include stateless persons; refugees who have received adverse security assessments; and refugees who are of interest to or have been charged by the Australian Federal Police (AFP). -

Social Justice Report 2001: Chapter 2: Mutual obligation, welfare reform and Indigenous participation: a human rights perspective
In recent years a mutual obligation approach has been adopted to reform public policy on welfare and employment issues. There has been much discussion about the applicability of this approach within an Indigenous policy context. It is seen by many as consistent with Indigenous cultural values such as reciprocity and an emphasis on community, as well as suggesting an antidote to the damage caused by intergenerational poverty, of which long-term welfare dependency and a crippling short-term local cash economy are often features. -

National Inquiry into Disability and Employment
While there were a range of factors that led the Commission to launch the Inquiry, the primary reason is that Australians with disability continue to be less likely to be employed than people without a disability.
