6. Australia's Immigration Detention Policy and Practice
Australian law requires the detention of all non-citizens who are in Australia without a valid visa (unlawful non-citizens). This means that immigration officials have no choice but to detain persons who arrive without a visa (unauthorised arrivals), or persons who arrive with a visa and subsequently become unlawful because their visa has expired or been cancelled (authorised arrivals). Australian law makes no distinction between the detention of adults and children. -

Alan used to work as a civil engineer, and is a trombone player with two orchestras and two bands. He has competed in the Australian Band Championships for the last three years. He sold his soils laboratory to 'retire', and has never looked back. He still works part-time in soil testing, but as well as trombone playing he is a volunteer in a Rotary shop, walks 30-40 kilometers weekly, won a silver medal in the 10 km Road Race in the Australian Masters Games 2012, and completed a novel for pre-teens called 'Alex', designed to raise awareness about healthy lifestyles. -

Recommendation for temporary exemption: S.A. Minister for Transport and Others
The Commission has previously granted a temporary exemption under section 55 of the Disability Discrimination Act 1992 (DDA) to the South Australian Minister for Transport, TransAdelaide and the South Australian Passenger Transport Board from the operation of section 24 of the DDA, specifically in relation to the lack of access for people who use a wheelchair to existing buses. -

Native Title Report 2000: Summary
The reconciliation process has made clear the pressing need for Aboriginal peoples to negotiate freely the terms of their continuing relationship with Australia. The report shows that the recognition of Indigenous people's right to their land and the origins of a nation are inextricably related and that changes to one part of the relationship infer and require changes to the other. This paper outlines major international research findings of the past ten years reflecting knowledge gathered about the psychological health of child and adolescent refugee/asylum seekers. In doing so, several key areas of consistency are identified. First, with the majority of research in this area centered on the prevalence of psychopathology, and particularly post-traumatic stress symptoms, it has been clearly demonstrated that refugee children and adolescents are vulnerable to the effects of pre-migration, most notably exposure to trauma. -

The Commonwealth Disability Discrimination Act 1992 (the "DDA") aims, as far as possible, to promote the rights of people with a disability to participate equally in all areas of life. It does this by making it unlawful to discriminate against a person with a disability, subject to a number of exceptions intended to balance the rights of people with disabilities with those of other persons. The areas where discrimination is unlawful include insurance and superannuation. -

MATT LAFFAN: I once used to say to some mates of mine that all I really wanted was 24 hours without a disability. I just wanted 24 hours so that I could do certain things. Since then, I've got a little greedy and now I want one week. And during that one week there'd be hell to pay, because Sydney just would not be big enough. I think the night club scene would be in a world of trouble, because dancing is something I'd really like to do. There'd certainly be a rugby match I'd have to get involved with. I'd go running with the old man. -
