Commission Determinations, DDA decisions
Prior to changes made by the Human Rights Legislation Amendment Act 1999 which took effect in April 2000, the Australian Human Rights Commission conducted hearings and made determinations on Disability Discrimination Act complaints referred to it by the Disability Discrimination Commissioner or delegate. Commission submission - NAAV
1. The key concept underlying the Commission's submissions is the proposition that the Australian legal system recognises, in various ways, an obligation to provide an effective remedy to persons present in this country whose interests have been adversely affected by a decision of an officer of the Commonwealth, where the decision is otherwise than in accordance with law. In this case, the need for an effective remedy is a need of non-citizens affected by decisions made under the Migration Act 1958 (Cth) ("the Act"). -

MR BROMWICH: Commissioner, before we start, I have been asked to place a concern on the record and I don't mean this to be in any sense a personal matter but it will have that flavour, I suppose. I've been asked to express a concern that there be no repeat of the sarcasm and personal attacks that were on occasions made yesterday. Commissioner, we are not aware that there has been the same approach taken to other witnesses before this Inquiry and indeed, I'm not aware that Counsel Assisting have been employed previously to, in effect, interrogate in part other witnesses. -

Special thanks goes to Maritza Manojlovic, Michele Nardelli and Rosemary Thompson who skilfully helped me to elaborate the arguments of the paper. To the Middle Eastern new arrivals that warmly welcomed me into their lives, ready to reveal their deepest concerns in the belief that they would be taken seriously, I say thank you. My greatest thanks goes to Mohammed Amirghiasvand for inspiring me to continue working in this area.
