Notice of application for temporary exemption: Tiger Airways
The Human Rights and Equal Opportunity Commission has received an application (attached in MS Word format) from Tiger Airways, dated 12 November 2007 and received 20 November 2007, requesting exemption from the Disability Discrimination Act and from the provisions of the Disability Standards for Accessible Public Transport so far as to excuse Tiger Airways from liability for failure to provide access for persons unable to board or disembark using passenger boarding stairs. The exemption is requested for the period to 29 February 2008. -

Throughout Australia’s history the relationship between the mining industry and Indigenous peoples has been less than harmonious. The drive for resources has seen the rights and interests of Indigenous peoples sacrificed in favour of economic growth. While many problems still remain today, there is evidence of a recent shift in the attitude of mining interests towards neighbouring Indigenous communities. Leading resource corporations such as Rio Tinto and Newmont have demonstrated willingness to formally recognise obligations towards traditional land owners and local Indigenous communities. -

Although it is not possible to precisely specify all the circumstance that lead people to arrive in Australia through people smuggling routes, there can be no doubt that they undertake perilous journeys which put their lives and that of accompanying family members at risk. Given the very high rates of approval for those who have sought asylum in Australia through these routes, it is reasonable to assume that most detainees have fled their countries for reasons of persecution.
