The intensive scrutiny and public awareness of this issue has not, however, led to sufficient commitments of resources and effort to date. -

Native Title Report 2002: Native title: the way forward
In the past 12 months the High Court has handed down several significant decisions which clarified the principles upon which the recognition and extinguishment of native title are determined. These principles are set out and discussed in the first three chapters of this report. In clarifying these principles, some of the Judges of the High Court have been mindful of their effect on Indigenous people. -

6. Australia's Immigration Detention Policy and Practice
Australian law requires the detention of all non-citizens who are in Australia without a valid visa (unlawful non-citizens). This means that immigration officials have no choice but to detain persons who arrive without a visa (unauthorised arrivals), or persons who arrive with a visa and subsequently become unlawful because their visa has expired or been cancelled (authorised arrivals). Australian law makes no distinction between the detention of adults and children. -

Commission Website: National Inquiry into Children in Immigration Detention
This Office issued a formal report on Immigration Detention Centres in March 2001 which contained a number of recommendations to DIMIA for improvements in arrangements for children. The investigation was conducted following complaints and a number of reported incidents including escapes and allegations of assault on detainees. It revealed evidence at every immigration detention facility of self-harm, damage to property, fights and assaults which suggested that there were systemic deficiencies in the management of detainees, including women and children. -

Social Justice Report 2003: Chapter 2: Reconciliation and government accountability
In the Social Justice Report 1999, my first report as Social Justice Commissioner, I identified four key themes and challenges that existed in the approach of the federal government to Indigenous policy making at the time. These were moving beyond welfare dependency, accountability, participation and reconciliation.[1] Since the release of that report approximately four years ago, the key themes and challenges facing the government have remained relatively constant. -

Native Title Report 2002: Introduction
The year under review in this, my fourth Native Title Report, is a year in which the High Court has handed down its decision in several significant native title cases thus elucidating the principles upon which the recognition and extinguishment of native title are determined. 2002 marks the end of a ten year period since the Mabo decision [1] first introduced the dual concepts of recognising and extinguishing native title.
