Commission Submission Amicus Curiae - Vickers v Ambulance Service NSW
These submissions are filed on behalf of the Acting Disability Discrimination Commissioner ('the Commissioner') in the event that leave is granted by the Court for the Commissioner to appear as amicus curiae in these proceedings pursuant to s 46PV(2) of the Human Rights and Equal Opportunity Commission Act 1986 (Cth) ('HREOC Act'). It is almost 40 years since the last man was hanged in Australia. Today, the death penalty has been abolished in every Australian jurisdiction. Opposition to the death penalty attracts bi-partisan political support. Yet in a region where many of our closest neighbours still maintain the death penalty, I believe Australia can - and should - take a stronger stand against state sanctioned execution. -

1. The present application does not specify the sections of the Disability Discrimination Act 1992 (Cth) (‘the DDA’) relied upon in making out the claim of unlawful discrimination. The Acting Disability Discrimination Commissioner (‘the Commissioner’) makes these general submissions on the assumption that the applicant characterises the alleged discrimination as indirect discrimination (as defined by s 6) in the manner in which access to premises is provided by the respondent (as made unlawful by s 23). -

I call my paper 'Social Justice Then Native Title' in order to make a clear distinction between two aspects of Indigenous People's struggle; the ultimate goals we are seeking to achieve and the means by which we seek to achieve them. Distinguishing the means and the ends, the former a servant of the latter, is a fundamental tenet of strategic thinking. And it is clear to me that a strategic approach will identify native title as simply a tool for achieving social justice for Indigenous people. -

Federal Anti-discrimination Law - 2004
In May last year I stepped down from my position as a Judge of the Federal Court to accept the role as President of HREOC. It has been a time of new challenges, such as the need to balance the legislative and administrative responsibilities that the Commission has been given by the federal government, with the important role of advocating for the rights of those on the margins of Australian society. -
