The RDA was the first Commonwealth unlawful discrimination statute to be enacted and is different in a number of ways from the SDA, DDA and ADA. This is because it is based to a large extent on, and takes important parts of its statutory language from, the International Convention on the Elimination of all Forms of Racial Discrimination.

The Human Rights and Equal Opportunity Commission ( Commission') was established by the Human Rights and Equal Opportunity Commission Act 1986 (Cth) ("the HREOC Act"). On 13 April 1995, His Honour Justice Carr directed that leave be granted to the Commission, pursuant to s.11(1)(o) of the HREOC Act, to file and serve written submissions in these matters limited to the issues referred to in the application, no later than 14 days prior to the hearing.

This is an inquest into the circumstances of the deaths of two Aboriginal men (approximately 37 and 21 years old) in Mutitjulu and one Aboriginal boy (approximately 14 years old) in Willowra. Without seeking to pre-empt any findings by the Coroner, the deaths all appear to be related to the sniffing of petrol.

"Not every disturbance or catastrophe qualifies as a public emergency which threatens the life of the nation, as required by article 4, paragraph 1. The Covenant requires that even during an armed conflict measures derogating from the Covenant are allowed only if and to the extent that the situation constitutes a threat to the life of the nation. If States parties consider invoking article 4 in other situations than an armed conflict, they should carefully consider the justification and why such a measure is necessary and legitimate in the circumstances.

This submission is based on research conducted by the Commission into hearing impairment and deafness in Aboriginal and Torres Strait Islander communities in 2009. The submission therefore focuses exclusively on hearing health in Aboriginal and Torres Strait Islander communities. The Commission only commenced this research recently but it is expected to be completed by December 2009.
