The complainant is 54 years of age and applied for a position with the respondent company. He said he had extensive experience with the company and claimed he and the company had an agreement that his application would be considered favourably. He alleged his application was ultimately unsuccessful and a younger person was appointed to the role. The company said it followed the usual recruitment process and appointed applicants of a range of ages to the role. The complaint was resolved with an agreement that the company pay the complainant $5,000. -

<p>The complainant has Multiple Chemical Sensitivity Disorder and lives at the respondent aged care facility. She claimed the facility proposed to install vinyl flooring in the corridor outside her room, which would produce fumes that may aggravate her disability.</p> <p>The aged care facility advised the vinyl flooring was being installed to help avoid falls by residents and engineers had advised fumes would be minimal.</p> -

HREOC attempts to resolve such complaints through conciliation where appropriate. If the matter is not resolved through conciliation and the President is satisfied that a breach of human rights or an act of discrimination has occurred, the President reports on the matter to the federal Attorney-General. -

<p>The complainant was employed as a shop assistant with the respondent food outlet. She alleged the franchise owner sexually harassed her, including by making comments about her body, taking private photos from her phone, lifting up her shirt, touching her and exposing himself to her.&nbsp;</p> <p>The business denied the allegations but agreed to participate in conciliation.</p> <p>The complaint was resolved with an agreement that the business pay the complainant $3,250 as general damages, develop anti-discrimination and harassment policies and deliver training to staff on those policies.</p> -

<p>The complainant alleged the respondent employment agency posted an advertisement seeking a ‘young’ security professional.&nbsp;</p> <p>The employment agency said a mistake had been made and there had been no intent to exclude any person from applying, or being considered, for the role on the ground of age. The agency undertook to amend the advertisement and deliver anti-discrimination training to new staff. The agency also advised it would contact the complainant to apologise for the incident.&nbsp;</p>
