The Complaint Handling Section (CHS) is responsible, through the President, for investigating and conciliating complaints lodged under federal anti-discrimination and human rights law. The CHS also delivers a Complaint Information Service. Accordingly, the CHS plays a key role in fulfilling the Commission's objective of delivering an Australian society in which human rights are protected.

The 2000-01 reporting year was a year of consolidation for the Commission’s Complaint Handling Section (CHS) following the legislative changes to the complaint handling function in April 2000.

The Human Rights and Equal Opportunity Act gives HREOC the function of inquiring into complaints concerning breaches of human rights by the Commonwealth (or persons/organisations acting on behalf of the Commonwealth) and discrimination in employment.

The President of the Human Rights and Equal Opportunity Commission (HREOC) is responsible for the investigation and conciliation of complaints lodged under federal anti-discrimination and human rights law. Staff of HREOC’s Complaint Handling Section (CHS) assist the President to investigate and resolve complaints. The CHS also provides information to the public about the law and the complaint process through the Complaint Information Service and a range of community education and training activities.

Federal human rights and anti-discrimination law provides for the Commission to investigate and resolve complaints of alleged discrimination and breaches of human rights. The Commission’s complaint work is central to its role in protecting and promoting human rights and complements the Commission’s policy and education functions. The Commission’s complaint process provides an effective, efficient and accessible means by which individuals and groups can voice and resolve disputes about discrimination and human rights.

The experience of people in rural and remote Australia has always featured prominently in the Commission's work. During the reporting year the Commission undertook two major projects addressing the human rights of children and young people in rural and remote Australia.

The Human Rights and Equal Opportunity Commission Act gives HREOC the function of inquiring into complaints concerning breaches of human rights or discrimination in employment. HREOC attempts to resolve such complaints through conciliation where appropriate. If the matter is not resolved through conciliation and the President is satisfied that a breach of human rights or an act of discrimination has occurred, the President reports on the matter to the federal Attorney-General.

The Disability Discrimination and Other Human Rights Legislation Amendment Act 2009 (Cth) has made a range of significant changes to federal discrimination laws. The focus of this paper is on the major changes to the Disability Discrimination Act 1992 (DDA), which commenced for the most part on 5 August 2009.

The Human Rights and Equal Opportunity Commission (HREOC) is seeking the views of the sex and gender diverse community about the most pressing human rights issues faced by people who are transgender, transsexual or intersex. HREOC also seeks input into how it might assist in promoting and protecting the human rights of people who are sex and gender diverse.

The Complaint Handling Section had a productive year investigating and conciliating complaints of alleged discrimination and human rights breaches; providing information to the public about federal anti-discrimination and human rights law through its Complaint Information Service and community education and liaison program; and providing complaint investigation and resolution skills training to state equal opportunity, anti-discrimination authorities, other Australian Public Service agencies and private companies.
