Pursuant to section 11(1)(f)(ii) of the Human Rights and Equal Opportunity Commission Act 1986 (Cth), I attach a report of an inquiry by the former President of the Commission into complaints made by immigration detainees against the Commonwealth of Australia. The former President found that the Commonwealth had breached the human rights of the complainants pursuant to articles 10(1) and 17(1) of the International Covenant on Civil and Political Rights. -

ADR as a tool for social change: a discussion (2008)
Human rights and anti-discrimination law in Australia, as in many countries in the Asia Pacific, provides for complaints about discrimination and violations of human rights to be resolved by conciliation. The use of Alternative Dispute Resolution (ADR) in this context has been criticised. In particular, it has been claimed that the individualised form of the complaint process, coupled with the confidential nature of conciliation outcomes, restricts the social reformative potential of human rights and anti-discrimination law. -

We see our organisation as being a positive role model for other employers and a leader in the public sector. We were the first public sector agency to offer Paid Maternity Leave of 18 weeks to our staff and six weeks paid parental leave. We have a range of flexible working arrangements in place that enable our staff to make choices that create harmony and balance in their lives. -

The meeting was facilitated by Omeima Sukkarieh and Susanna Iuliano from HREOC and was attended by 12 participants from the Arabic Workers Network. The network is convened by the Australian Arabic Communities Council to encourage workers whose clients are members of Sydney's Arabic community to exchange information and develop skills through regular bi-monthly meetings, information sessions and training workshops. The network is comprised of approximately 190 members. -
