"There have been times in our history when Australia has been generous and open hearted and times when it has been very mean. In 1938 at the Evian Conference about dealing with Jewish and other refugees from Hitler, Australia took a flint hearted position, saying that we did not want to import Europe's problems, or to increase racial differences, and that refugees should get back in the queue.

Lateral violence is a multilayered, complex problem and because of this our strategies also need to be pitched at different levels. In Chapter 3 I have looked at the big picture, with the human rights framework as our overarching response to lateral violence. In this Chapter I will be taking our strategies to an even more practical level, looking at how we can create environments of cultural safety and security to address lateral violence.

We must face up to our humanitarian responsibilities to accept refugee children and their families. We must take them out of the immigration detention centres and welcome them into the community where they can play, learn and grow. At least then when our children look back on this time and ask us what we did to stand up for refugee kids, we can say we gave them their childhood." (Calvert, 2001).

DR OZDOWSKI: This is one of a series of hearings to be conducted around Australia. My name is Dr Sev Ozdowski and I am the Human Rights Commissioner and I am assisted in the Inquiry by two colleagues of mine, Mrs Robin Sullivan who is to the left of me, the Queensland Children's Commissioner. To the right of me is Dr Trang Thomas who is a Professor of Psychology at Melbourne Institute of Technology. Also at the table is sitting Ms Vanessa Lesnie who is Secretary to the Inquiry.

Last year I set out my priorities for my term as Social Justice Commissioner.[1] My priorities revolve around the central idea that to address the disadvantage faced by Aboriginal and Torres Strait Islander peoples and build a more reconciled nation, we need to develop stronger and deeper relationships:

On my right is Professor Trang Thomas, Professor of Psychology at the Royal Melbourne Institute of Technology and on my left Mrs Robin Sullivan, who is also the Queensland Children's Commissioner. Before the hearing commences I would like to note the following matters. First, the issue of confidentiality and privacy. The Commission believes it is important to respect the privacy of individuals and to protect children in particular. Even where individual cases have been made public elsewhere, individual's names should not be named in this hearing.

The literature review pulls together some of the main concepts and findings about Indigenous young people with cognitive disabilities and/ or mental health issues from involvement with the juvenile justice system. However, we are also interested in finding out what is actually happening on the ground for these young people.

It was a landmark for Australia - the first federal law to say that all people have the right to be treated fairly, regardless of their background, culture or colour.

DR OZDOWSKI: I would like to formally open the second day of hearings in Adelaide. This is one of the hearings conducted around Australia for the National Inquiry into Children in Detention. My name is Sev Ozdowski, I'm the Human Rights Commissioner. With me is Mrs Robin Sullivan to my left, who is Queensland Children's Commissioner, and Dr Trang Thomas, on my right, is Professor of Psychology at the Royal Melbourne Institute of Technology. They are Assistant Commissioners helping me with the Inquiry.

To develop a nationwide picture of existing government initiatives that address family violence, the Social Justice Commissioner sent correspondence to all State, Territory and relevant Australian government departments[1] requesting information on their policies and programs during the period 2006-2007.
