The aim of this submission is to inform HREOC, at the outset of its Inquiry, of the concerns held about Children in Immigration in Detention, by members of the legal profession in New South Wales. The focus of the submission is limited to the issue of compliance with international and domestic legal obligations. Relevant obligations are outlined, concerns are highlighted and finally, recommendations to address those concerns are listed. The Law Society welcomes any future opportunity to address any specific matters in greater detail at the request of HREOC. -

3. I am a qualified and registered Psychologist, and hold a BA, MA, Teaching Certificate, and PhD. I have been working as psychologist in Australia since 1978, and worked previously in Canada as a psychologist and teacher. I have also previously worked for Family and Youth Services in South Australia. -

The Mercy Refugee Service is part of the relief and development cross-cultural work of the Institute of Sisters of Mercy Australia. Mercy Refugee Service is entrusted to serve without discrimination the uprooted and displaced people in our world. It was established in 1983 to respond to the plight of refugees in south-east Asia. At that time volunteers were called on to provide health care, education, social welfare and counselling support to refugees in camps in Malaysia, Thailand, Hong Kong, the Philippines and in Cambodia. -

It will address the first term of reference [3] for the Inquiry. The submission will first consider the right to nationality at international law and the problem of ‘statelessness’, before discussing Australia’s domestic law. -

Refugees are a group at high nutrition risk. There is a strong duty of adequate nutritional care for institutionalised persons. The Dietitians Association of Australia (DAA) is the largest member organisation for nutrition professionals in Australia. It is notable that DAA has been unable to identify significant input by nutrition professionals into the planning or provision of care for asylum seekers in Australia. -

MR BROMWICH: Commissioner, before we start, I have been asked to place a concern on the record and I don't mean this to be in any sense a personal matter but it will have that flavour, I suppose. I've been asked to express a concern that there be no repeat of the sarcasm and personal attacks that were on occasions made yesterday. Commissioner, we are not aware that there has been the same approach taken to other witnesses before this Inquiry and indeed, I'm not aware that Counsel Assisting have been employed previously to, in effect, interrogate in part other witnesses. -

The City of Port Adelaide Enfield conducts regular public immunisation clinics for all residents. During 2001, families who were ex Woomera and Port Hedland detainees, who have settled in the local area, attended the immunisation clinics. It was evident that the families required special needs including interpreters, therefore the Community Health Nurse approached Child & Youth Health to undertake a joint pilot project to offer a specific program targeted at new arrivals to the area. -

This submission addresses some of the issues and questions raised in the background papers prepared by the Human Rights and Equal Opportunity Commission (HREOC) and in relation to the United Nations Convention on the Rights of the Child (1989) and the Convention Relating to the Status of Refugees (1951) and its 1967 Protocol (the Refugee Convention). The conclusions drawn in this submission arise out of the experiences of staff and members of the Uniting Church in Australia. We do acknowledge that the evidence presented here is therefore anecdotal. -
