National Inquiry into Children in Immigration Detention
Australia is a signatory to a number of International Conventions, which are relevant to mandatory detention of children in Australia’s immigration detention centres. Under International law, each of the conventions that Australia has ratified is binding on the Australian state, which is obliged to bring its domestic laws into conformity with their stipulations. In Australia, International Conventions do not have legal force in domestic law, and cannot be directly applied by the domestic courts in Australia, unless the Australian Parliament enacts them into legislation. -

Over the last four years the Human Rights and Equal Opportunity Commission (the Commission) has played a key role in raising community awareness about the human rights Australians with a mental illness. The Commission, through its public inquiry process, brought into national focus how, amongst other things, people affected by mental illness frequently faced discrimination and stigmatisation based on ignorance, fear and inaccurate stereotypes. -

One of my primary responsibilities is to report annually on the enjoyment and exercise of human rights by Aboriginal and Torres Strait Islander peoples. I also report annually on the operation of the Native Title Act 1993 (Cth) (the Native Title Act) and the effect of the Act on the exercise and enjoyment of human rights of Aboriginal and Torres Strait Islander peoples. In 2014, I have again combined the reporting requirements into the Social Justice and Native Title Report, which covers the period from 1 July 2013 to 30 June 2014. -

This is the third successive Social Justice Report to report on the implementation of the new arrangements for Indigenous affairs at the federal government level. The current mandatory detention policy of the Commonwealth of Australia breaches the fundamental principle of the rights of the child which is that children should be able to develop to their full potential. The policy breaches every article of the Convention on the Rights of the Child. The policy violates the right to health as established by international law. -

In our opinion, this is a very timely and important Inquiry into an area of great significance to Australia as a nation and to the way that Australia is perceived internationally.
