Catherine Branson welcomed guests, in particular international guests and acknowledged the traditional owners of the land. She thanked the Asia Pacific Forum of National Human Rights Institutions for co-hosting the seminar. She acknowledged the importance of the right to be free from torture, and congratulated the Australian Government for recognising the rights of those deprived of their liberty by signing the Optional Protocol to the Convention Against Torture (OPCAT). She noted that Australia faces challenges in implementing OPCAT, particularly due to its federal structure.

Native title agreements are emerging as an important tool in defining the rights of native title holders over their land. As Aboriginal and Torres Strait Islander Social Justice Commissioner I welcome negotiation and agreement-making as a way of establishing a stable and enduring basis for a dynamic and long term relationship between Indigenous and non-Indigenous people over land. However I am concerned that throughout this process there are currently no mechanisms to ensure that the human rights of Indigenous people are being respected.

I am delighted to present my first statement as President of the Human Rights and Equal Opportunity Commission. Much of what is reported in this volume occurred before I took up my appointment. The last twelve months have been a time of challenge and success for the Commission as it continues the important task of promoting and protecting the observance of human rights in Australia.

Dr Sev Ozdowski OAM commenced duty as Acting Disability Discrimination Commissioner in December 2000 in addition to his duties as Human Rights Commissioner. In April 2003 the Attorney-General announced an extension of this acting position until 3 April 2004.
