The meeting was attended by Susanna Iuliano and Omeima Sukkarieh from HREOC and by 7 invited participants from the Muslim Lawyers’ Group. The group is an informal social network (formed in late 2002) of Muslim lawyers practising in Melbourne.

My name is Keysar Trad. I am the Vice President of the Lebanese Muslims Association in Sydney. The Lebanese Muslims Association was established in 1961 by a group of Lebanese Muslim citizens to advocate on behalf of Lebanese and other Muslims in the Australian community. We have over 1100 financial members and over tens of thousands who use our facilities on festive occasions, many or our members (financial and non financial) meet at our mosques five times a day to offer worship and over 5000 members meet every Friday at midday for worship services.

Native title agreements are emerging as an important tool in defining the rights of native title holders over their land. As Aboriginal and Torres Strait Islander Social Justice Commissioner I welcome negotiation and agreement-making as a way of establishing a stable and enduring basis for a dynamic and long term relationship between Indigenous and non-Indigenous people over land. However I am concerned that throughout this process there are currently no mechanisms to ensure that the human rights of Indigenous people are being respected.

In recent years there have been significant developments at the international level that impact upon the recognition and protection of the human rights of indigenous peoples. Most notably, there have been: i) reforms to the machinery of the United Nations (UN) and the emphasis given to human rights within that system; ii) the making of global commitments to action, through the Millennium Development Goals (MDGs) and the Second International Decade of the World’s Indigenous People; and iii) the further elaboration of human rights standards as they apply to indigenous peoples.

This report contains a summary of observations by the Australian Human Rights Commissioner, Graeme Innes AM, and staff of the Australian Human Rights Commission (the Commission) following visits to Australia’s immigration detention facilities, and to people in community detention, between June and September 2008. The contents of the report are based on direct observations made during the visits, and on discussions with staff and immigration detainees.
