The deceased was serving a life sentence for murder, having been convicted on 26 April 1978. In April 1991 he was granted permission to attend the University of Tasmania to undertake a bridging course. The deceased signed an agreement which regulated his attendance at the course. He breached the agreement on 15 August 1991 when he left his authorised custodian and consumed alcohol. He was subsequently informed he would be returned to maximum security with a review of his current arrangements and classification.

DR OZDOWSKI: This is one of a series of hearings to be conducted around Australia. The consultation invited comments on the potential benefit of federal laws protecting people from discrimination and harassment. Overwhelmingly, participants argued that introducing such protections would result in significant benefits for the Australian community as a whole. A small number of participants argued that there would be no benefit from these protections.

Australian Lawyers for Human Rights (ALHR) is a network of Australian lawyers interested in furthering awareness and advocacy of human rights in Australia. Under section 46C(1)(a) of the Human Rights and Equal Opportunity Commission Act 1986 (Cth), the Social Justice Commissioner is required annually to submit a report to the Attorney-General on the exercise and enjoyment of human rights by Aboriginal persons and Torres Strait Islanders (the Social Justice Report).

<h3>1.1 Introduction</h3> <p>In last year’s <i>Social Justice and Native Title Report</i>, I raised concerns about the changes resulting from the 2014-15 Budget and the restructure to Indigenous Affairs through the Indigenous Advancement Strategy (IAS).</p> <p>Despite initial concerns about how these changes would impact our communities, I indicated that the streamlining of programs and the move away from a ‘one size fits all’ mentality had the potential to offer great benefit and flexibility for Aboriginal and Torres Strait Islander peoples.</p>

The 'right to negotiate' is a fundamental right assured by the Commonwealth Native Title Act (the 'NTA') and reflected in international human rights standards. Yet in practice the capacity of native title parties to exercise their 'right to negotiate' is determined by factors other than the mere existence of the right. Given the primary role of state and territory governments in land administration, their policies regarding the administration of the right to negotiate have a significant impact on native title parties' capacity to exercise their 'right to negotiate'.

This submission will consider the issue of ‘statelessness’ and its consequences for the nationality of children in detention [2], focussing specifically on those children who are born into immigration detention in Australia. It will address the first term of reference [3] for the Inquiry. The submission will first consider the right to nationality at international law and the problem of ‘statelessness’, before discussing Australia’s domestic law.

CARAD is a group of volunteers, supporters and donors formed from January 2000, in an attempt to meet some of the range of essential and urgent needs of refugees who reach Perth, following assessment of their claim while in a detention centre. We have now met in excess of 2,000 refugees, not all of whom remain in WA, and have provided them with compassionate, practical assistance. We estimate that there are about 1000 individual volunteers, supporters and donors affiliated with CARAD.
