Within months of the `First Fleet' arrival at Sydney Cove in 1788 there was `open animosity' as Indigenous people protested against `the Europeans cutting down trees, taking their food and game, and driving them back into others' territories'. Bitter conflict followed as Aboriginal people engaged in `guerilla warfare - plundering crops, burning huts, and driving away stock' to be met by `punitive expeditions of great ferocity in which bands of Aborigines encountered were indiscriminately killed' (Bickford 1988 page 57).

I am pleased to present herewith a submission on behalf of the Association of Childrens Welfare Agencies, addressing key issues for the Inquiry into Children in Immigration Detention.

</B>The Yankunytjatjara and Pitjantjatjara and other Indigenous people of the town of Yulara, in the shadows of Uluru, had their claim for compensation for extinguishment of native title rejected by Justice Sackville in the Federal Court (the Jango case)1in 2006. The Noongar people (the Noongar case)2 had their claim for native title over the metropolitan area of Perth upheld. Further north, around Darwin, the Larrakia people (the Larrakia case)3 learned that the common law would not recognise their native title when Justice Mansfied handed down his decision.

Barnardos Australia is a family support and out of home care children's welfare agency operating services in New South Wales and ACT. We make this submission based on a number of detainee children and young people that we have provided services for within their own families, and as homeless adolescents. Furthermore, Barnardos has general experience of the impact of institutional care of children and young people, and children living with uncertainty and stress. We have proved specialist support services to refugee Indo-Chinese young people who have experienced detention in refugee camps.

This Office issued a formal report on Immigration Detention Centres in March 2001 which contained a number of recommendations to DIMIA for improvements in arrangements for children. The investigation was conducted following complaints and a number of reported incidents including escapes and allegations of assault on detainees. It revealed evidence at every immigration detention facility of self-harm, damage to property, fights and assaults which suggested that there were systemic deficiencies in the management of detainees, including women and children.

The Lebanese Muslims Association was established in 1961 by a group of Lebanese Muslim citizens to advocate on behalf of Lebanese and other Muslims in the Australian community. We have over 1100 financial members and over tens of thousands who use our facilities on festive occasions, many or our members (financial and non financial) meet at our mosques five times a day to offer worship and over 5000 members meet every Friday at midday for worship services.
