Native Title Report 2001: Chapter One: The Right to Negotiate and Human Rights
The 'right to negotiate' is a fundamental right assured by the Commonwealth Native Title Act (the 'NTA') and reflected in international human rights standards. Yet in practice the capacity of native title parties to exercise their 'right to negotiate' is determined by factors other than the mere existence of the right. Given the primary role of state and territory governments in land administration, their policies regarding the administration of the right to negotiate have a significant impact on native title parties' capacity to exercise their 'right to negotiate'. -

We have heard many tragic stories of women, children and young people who have experienced devastating sexual abuse and family violence. Hastings: Transition
When I was discussing this event with Jenni Huon we talked about whether the theme should be "transition" or "transitions". At the time I thought it did not matter much, but as soon as I started to write this address I realised that I am going to talk about "transition". "Transitions" (plural) suggests one discrete thing after another, a beginning, middle and end before another beginning. It is a word describing things, separate events, bits of life that can be captured, have edges put round them. -

The standard sort of speech that is often delivered by people in my sort of position at this sort of event is a combination of pep talk and pamphlet, with some bits of a law lecture thrown in: telling people with a disability and their advocates that they have rights under discrimination law, and telling employers that they have responsibilities, and attempting to set out the terms and the effect of the provisions of the Disability Discrimination Act (or "DDA"). -

One of the underlying goals of international and Australian laws relating to children with disabilities is to provide the highest possible level of support and assistance in the least restrictive way. Laws, policies and programs should be designed to ensure that children with disabilities have the opportunity to participate, to the maximum extent possible, in all aspects of the general community.
