Amicus Submission: Ferneley
1. On 22 October 2001 the Sex Discrimination Commissioner ("the SD Commissioner") filed a Notice of Motion seeking to move the Court for orders that the SD Commissioner be granted leave to appear as amicus curiae in these proceedings, together with any consequential orders and directions. The Notice of Motion was supported by an affidavit of the SD Commissioner affirmed on 19 October 2001. -

ACDE is the national peak organisation representing deans of faculties of education and heads of schools of education in Australian universities, and in other institutions providing recognised teacher education qualifications. ACDE members are responsible for initial and post-initial teacher education (schools, VET, early childhood, tertiary, some other instructors/educators), education research and scholarship, and education research training. -

Native Title Report 2002: Extinguishment of Native Title
The two recent High Court decisions in Miriuwung Gajerrong [1] and Wilson v Anderson [2] have clarified some important issues regarding the extinguishment of native title under the Native Title Act 1993 (Cwlth) (‘NTA’) and its relationship with extinguishment under the common law. They also provide some important insights into the meaning of discrimination as it responds to the specific issues raised by the recognition of native title, a proprietary interest which is inherent to a particular racial group. -

Native Title Report 2002: Table of Tenures/Interests and their Affect on Native Title
It is important to note that most tenures and interests continue to affect native title even after they have ceased. So, for instance, an area of land may currently be unallocated crown land, but all previous tenures/interests in that land will have permanently affected, and possibly extinguished, native title rights (unless the land comes within the few exceptions under the Native Title Act 1993 (Cwlth) (‘NTA’) – sections 47, 47A & 47B). The following table summarises tenures examined in Miriuwung Gajerrong [1] and Wilson v Anderson. [2] -

Forty eight years ago this Tuesday, on December 10 1948, the United Nations General Assembly adopted the Universal Declaration of Human Rights. The declaration was a response to the trauma that many of the world’s nations had experienced in World War II. The trauma was especially strong among the nations of Europe, particularly because of the Holocaust, but it was also evident in East Asia, South Asia, South East Asia and the Pacific. -
