Social Justice Report 2006: Chapter 4: International developments on the rights of indigenous peoples – Closing the ‘protection gap’
In recent years there have been significant developments at the international level that impact upon the recognition and protection of the human rights of indigenous peoples. Most notably, there have been: i) reforms to the machinery of the United Nations (UN) and the emphasis given to human rights within that system; ii) the making of global commitments to action, through the Millennium Development Goals (MDGs) and the Second International Decade of the World’s Indigenous People; and iii) the further elaboration of human rights standards as they apply to indigenous peoples. -

4. Australia's Human Rights Obligations
The purpose of this chapter is to explain the relevance of international human rights law to children in Australia's immigration detention centres and to provide a quick reference point on the fundamental human rights principles that have influenced the approach of this Inquiry. This chapter also explains the role of United Nations (UN) guidelines in the Inquiry's analysis of Australia's human rights treaty obligations. -

Recommendation for temporary exemption: S.A. Minister for Transport and Others
The Commission has previously granted a temporary exemption under section 55 of the Disability Discrimination Act 1992 (DDA) to the South Australian Minister for Transport, TransAdelaide and the South Australian Passenger Transport Board from the operation of section 24 of the DDA, specifically in relation to the lack of access for people who use a wheelchair to existing buses. -

Every morning our people would crush charcoal and mix that with animal fat and smother that all over us, so that when the police came they could only see black children in the distance. We were told always to be on the alert and, if white people came, to run into the bush or run and stand behind the trees as stiff as a poker, or else hide behind logs or run into culverts and hide. Often the white people - we didn't know who they were - would come into our camps. And if the Aboriginal group was taken unawares, they would stuff us into flour bags and pretend we weren't there. -

1. The key concept underlying the Commission's submissions is the proposition that the Australian legal system recognises, in various ways, an obligation to provide an effective remedy to persons present in this country whose interests have been adversely affected by a decision of an officer of the Commonwealth, where the decision is otherwise than in accordance with law. In this case, the need for an effective remedy is a need of non-citizens affected by decisions made under the Migration Act 1958 (Cth) ("the Act"). -

National Inquiry into Children in Immigration Detention
Although it is not possible to precisely specify all the circumstance that lead people to arrive in Australia through people smuggling routes, there can be no doubt that they undertake perilous journeys which put their lives and that of accompanying family members at risk. Given the very high rates of approval for those who have sought asylum in Australia through these routes, it is reasonable to assume that most detainees have fled their countries for reasons of persecution. -

Mandatory detention laws in Australia (2001)
This paper gives a brief overview of the mandatory detention laws currently operating in the Northern Territory and Western Australia. It examines their operation and gives some insights into how they have impacted on particular groups including young people and Indigenous Australians. It gives a critique of mandatory detention by reference to Australia's international human rights obligations, with particular emphasis on the United Nations Convention on the Rights of the Child. The paper cites a number of recent reports and articles dealing with this subject. -
