Since the terrorist attacks on September 11 2001, Governments around the world have created a raft of new counter-terrorism laws. In Australia alone, over 40 new laws have created new criminal offences, new detention and questioning powers for police and security apparatus, new powers for the Attorney-General to proscribe terrorist organisations, new ways to control people’s movement and activities without criminal convictions, and new investigative powers for police and security agencies. -

Good afternoon, I’d like to begin by acknowledging the Noongar people, the traditional owners and custodians of the land where we are gathered today, and pay my respects to their elders. I’d also like to acknowledge my distinguished fellow speakers. My presentation today is focused on customary law. I will refer to Aboriginal customary law, though the points that I will make are equally relevant to Torres Strait Islanders and to their distinct systems of law and governance. -

Native title is now well established in Australian law. The native title system was set up in 1994 under the Native Title Act 1993 (Cth) (the Native Title Act). It is for gaining recognition and protection of native title, and for resolving native title matters. It has been successfully used in many parts of the country. -

Native Title Report 2006: Chapter 4: South Australia’s State-Wide Indigenous Land Use Agreement (ILUA) Framework
In most states and territories of Australia, Indigenous Land Use Agreements (ILUAs) are negotiated on a case by case basis between the relevant parties, usually traditional owners, governments and industry groups. South Australia however, has taken a more comprehensive approach to these agreements. The South Australian Government, Indigenous traditional land owners and industry stakeholders have developed a state-wide framework that streamlines ILUA processes and reduces the resources that are required for successive negotiations. -
