Launch of the Rights & Responsibilities Consultation 2014 Report
Thank you for coming. It's a great pleasure to launch the report from our Rights and Responsibilities Consultation . Like my Commissioner colleagues, the role of Australia’s Human Rights Commissioner is to look at systemic public policy issues. No Commissioner investigates complaints from the public. That is the role of the President. On my arrival the President and I divided policy ... -

The forcible removal of Indigenous children from their families occurred during two periods in Tasmania. The first commenced with the European occupation of Van Dieman's Land (as Tasmania was called until 1856) in 1803 and lasted until the middle of the nineteenth century. The second commenced in the 1930s with the forcible removal of Indigenous children from Cape Barren Island under general child welfare legislation and continues into the present. -

Native Title Report 2001: Chapter One: The Right to Negotiate and Human Rights
The 'right to negotiate' is a fundamental right assured by the Commonwealth Native Title Act (the 'NTA') and reflected in international human rights standards. Yet in practice the capacity of native title parties to exercise their 'right to negotiate' is determined by factors other than the mere existence of the right. Given the primary role of state and territory governments in land administration, their policies regarding the administration of the right to negotiate have a significant impact on native title parties' capacity to exercise their 'right to negotiate'. -

2019 Human Rights Day Oration
The Hon Peter McClellan AM QC 10 December 2019 I recently visited the Peace Memorial in Hiroshima. It is a confronting but moving experience. It is a memorial to the people the allies believed it necessary to kill to win the war. They were also intent on emphasising to the world that they had the most powerful weapon ever invented. They chose to detonate the bomb in an urban area rather than ... -

Launch of the Supreme Court Equal Treatment Benchbook
When I first entered the law 'benchbooks' were closely guarded, leather bound books into which judges carefully entered notes as a case progressed - usually I thought adverse comments and exclamation marks about one's arguments or less than flattering remarks about one's principal witness. These books seemed to be some kind of secret code to the outcome of cases and never saw the light of day. -

The AHRC and the Racial Discrimination Act: setting the record straight
Federal racial hatred legislation and the complaints-handling processes of the Australian Human Rights Commission (AHRC) are currently the subjects of an inquiry by the Parliamentary Joint Committee on Human Rights. The Committee’s ‘Freedom of speech in Australia’ inquiry, due to report by 28 February 2017, is giving particular attention to sections 18C and 18D of the Racial Discrimination Act. It ... -

Bringing them Home - Chapter 9
In 1863 the area now known as the Northern Territory came under the control of South Australia. By 1903 the whole area was leased to non-Indigenous people. As there were few non-Indigenous women, relationships between the Indigenous women and non-Indigenous men were relatively common. The consequence was a growing population of children of mixed descent who were usually cared for by their mothers within the Aboriginal community.
