The title of this session on the conference program is 'The history of human rights in Australian law'. I have chosen to slightly change the topic for a number of reasons. The main reason is because Indigenous peoples' struggle for recognition of their human rights remains to a large extent unfulfilled. Consequently, it is not, and has never been, well reflected in Australian law. Second, because human rights continue to be poorly and rather patchily implemented in our legal system. -

Social Justice Report 2006: Chapter 2: The new arrangements for Indigenous affairs – facilitating Indigenous access to government services
It has now been over two years since the federal government introduced new arrangements for the administration of Indigenous affairs. One of the catchcries of the new arrangements is that they are aimed at ‘harnessing the mainstream.’ This is to be achieved by removing or reducing the barriers that prevent Indigenous peoples from accessing existing mainstream services on an equitable basis. -

This timeline focuses on one particular aspect of the history of Aboriginal and Torres Strait Islander peoples - the forcible removal of Indigenous children from their families. I'm honoured to give this address. I completed my law degree at this university, and well remember the December day in 1977 when I received it. It was the culmination of four years of hard work, experiencing the pleasures and trials of campus life, and acquiring - as well as a reasonable amount of legal knowledge - a much broader appreciation of the world around me, warts and all. -

Age Discrimination: exposing the hidden barrier for mature age workers
Since the introduction of the Age Discrimination Act 2004 (Cth), experiences of age discrimination in employment among mature age workers have featured prominently in the complaints of age discrimination received by the Australian Human Rights Commission. In 2008-09, I undertook a series of consultations with peak bodies including age-based community groups, legal service providers, business groups, unions, academics and relevant government departments. As well I undertook research to learn more about the barriers to employment facing mature age workers. -

Diabetes in Indigenous Communities
May I also congratulate the organisers for convening this important Forum. We know that rates of diabetes among indigenous peoples across the globe, and in Australia, are extremely high and require specific, focused attention. And we also know that we need action urgently.
