Pursuant to s 31(b)(ii) of the Human Rights and Equal Opportunity Commission Act 1986 (Cth), I attach, on behalf of the Commission, a report of an inquiry conducted by my predecessor, Professor Alice Tay. The inquiry dealt with a complaint of discrimination in employment by Mr Kenneth Douglas against the Commonwealth of Australia (Australian Defence Force). -

As a theme for today's discussion, I have chosen the notions of regionalisation and responsibility within Asia and the Pacific. I believe that the ability to accept responsibility for our neighbourhood, and to generate cooperative regional dialogues and actions to fulfill that responsibility will be the key to meeting the challenges and opportunities human rights will face in the new century. -

I call my paper 'Social Justice Then Native Title' in order to make a clear distinction between two aspects of Indigenous People's struggle; the ultimate goals we are seeking to achieve and the means by which we seek to achieve them. Distinguishing the means and the ends, the former a servant of the latter, is a fundamental tenet of strategic thinking. And it is clear to me that a strategic approach will identify native title as simply a tool for achieving social justice for Indigenous people. -

Where a complaint is made under the Human Rights and Equal Opportunity Commission Act 1986 (Cth) alleging breaches of human rights and discrimination in employment, the President or his delegate may report to the Attorney-General where conciliation cannot resolve the matter and an inquiry has satisfied the President there has been a breach of human rights or discrimination in employment. The Legal Section assists the President or his delegate to inquire into the complaints and prepare reports to the Attorney-General. -

During this time, the world's attention has been focussed on the international terrorist threat and how governments, including our own, can contain and counter that threat. In Australia, the Commission has been mindful of the fact that any counter-terrorism measures must be enacted and administered in accordance with existing domestic and international laws, including human rights laws. -

"There have been times in our history when Australia has been generous and open hearted and times when it has been very mean. In 1938 at the Evian Conference about dealing with Jewish and other refugees from Hitler, Australia took a flint hearted position, saying that we did not want to import Europe's problems, or to increase racial differences, and that refugees should get back in the queue. -
