President speeches: Development, Security and Human Rights

New security measures give government authorities unprecedented powers, which can seriously infringe the basic human rights of those against whom the powers are exercised. -

Family violence and abuse is causing untold damage to the cultures and fabric of Indigenous societies. It is damaging our communities, our families, our women, our children and our men. Lateral violence is a multilayered, complex problem and because of this our strategies also need to be pitched at different levels. In Chapter 3 I have looked at the big picture, with the human rights framework as our overarching response to lateral violence. In this Chapter I will be taking our strategies to an even more practical level, looking at how we can create environments of cultural safety and security to address lateral violence. -

Northern Territory Emergency Response Review Board
The government has an obligation to take action to address violence and abuse, particularly where there is evidence that is it widespread. Governments that fail to do so are in breach of their obligations under the Convention on the Rights of the Child (CRoC), the International Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW) and the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD). -

Torture and various forms of terrorism have been practiced throughout history, though never on the scale we are now confronted with. The first visual records of police interrogation were discovered in a four thousand year old tomb in ancient Egypt. Since the pharaohs there have been many refinements in methods of inducing physical pain and gathering intelligence, most notably during the Spanish Inquisition, but more recently in the modern totalitarian state. -

“If the measures were targeted solely to parents or families in need of assistance to prevent neglect or abuse of children, as they are in s123UC of the legislation, then some form of income management may be capable of being seen as an appropriate exercise of the governments ‘margin of discretion’ to ensure that families benefit from welfare and receive the minimum essentials for survival.”[13] -
