Indigenous people enter a relationship with the State on the basis of their identity as the traditional owner group of an area of land. Commission Determinations, DDA decisions
Prior to changes made by the Human Rights Legislation Amendment Act 1999 which took effect in April 2000, the Australian Human Rights Commission conducted hearings and made determinations on Disability Discrimination Act complaints referred to it by the Disability Discrimination Commissioner or delegate. Complaints were referred to the Commission because the complaint could not be settled by conciliation or because the nature of the matter was such that it should be determined by the Commission. -

Native Title Report 2006: Appendix 3: Recommendations and relevant international human rights law
At the international level there are three broad categories of obligation to which a state may be subject: treaty law, customary international law and emerging international standards. Treaty obligations become binding on states once they have ratified a treaty. This means that the state allows itself to be bound by the conditions and obligations contained within the treaty. Customary international law is enshrined in continuous practice by a majority of states over an extended period of time. -

The Mercy Refugee Service is part of the relief and development cross-cultural work of the Institute of Sisters of Mercy Australia. Mercy Refugee Service is entrusted to serve without discrimination the uprooted and displaced people in our world. It was established in 1983 to respond to the plight of refugees in south-east Asia. At that time volunteers were called on to provide health care, education, social welfare and counselling support to refugees in camps in Malaysia, Thailand, Hong Kong, the Philippines and in Cambodia. -

HREOC submission to Inquiry into Immigration Detention in Australia
Recommendation 1: The Migration Act should be amended so that detention occurs only when necessary. This should be the exception not the norm. It must be for a minimal period, be reasonable and be a proportionate means of achieving at least one of the aims outlined in international law (ExComm Conclusion 44). These limited grounds for detention should be clearly prescribed in the Migration Act.
