Governments must end youth detention abuse

The Australian Human Rights Commission today expressed continuing and deep concern about the abuse of young people in detention.

“The focus on punitive measures is failing young people. A much better approach is to focus on effective early intervention, prevention and diversion programs,” said the Aboriginal and Torres Strait Islander Social Justice Commissioner, June Oscar.

The National Children’s Commissioner, Megan Mitchell, said Australia has around 900 children and young people in youth justice detention at any one time.
-

I accepted the invitation to make this Oration and come here tonight with some trepidation: The person being honoured tonight, Dame Roma Mitchell, was the first federal Human Rights Commissioner and this is the territory that has known the powers of persuasion, conviction and commitment of the best human rights minds in the country, including Dame Roma Mitchell herself. Yet I reminded myself that we are both cultivators in the same vineyard, albeit that I both lagged behind her and sought to learn from her. My work today is made easier by the clear and decisive path cut out by my predecessor. -

Frequently Asked Questions

What is the Declaration on the Rights of Indigenous Peoples?

The Declaration is a set of principles which describe equality, non-discrimination, partnership, consultation and cooperation between Indigenous peoples and governments. It is a comprehensive standard on human rights for Indigenous Peoples. The Declaration is not legally binding and it does not compel governments to certain actions. Rather, it is an aspirational human rights instrument that explicitly encourages harmonious and cooperative relations between governments and Indigenous peoples.
-

Native Title Report 2000: Chapter 3: Native title and sea rights
One of the major events of the period covered by this report was the handing down of the decision by the full Federal Court in the Croker Island case (1) on appeal from the decision of Justice Olney. (2) It is the major test case on the recognition of native title sea rights and represents the most authoritative statement of the law in Australia at the present time. It was a split decision and this chapter analyses the human rights implications of the different legal positions adopted by the majority and the minority decisions of the court. -

I begin by acknowledging the Gadigal people of the Eora nation, the traditional owners of the land where we meet today, and pay my respects to their elders. I would also like to thank the LIME conference organisers -- and Gregory Phillips and Lisa Jackson-Pulver in particular -- for inviting me to speak tonight and for organising this event and for ensuring that Indigenous health – so often overlooked in the ongoing debates about health and health reform in Australia – receives the attention it deserves in this context. -
